On December 13, 2012, a Baldwin County (AL) jury returned the largest civil wrongful death verdict in the county’s history in the case of Sharon Juno, who was administered a fatal dosage of insulin as the result of a transcription error in the patient’s medical record. The $140 million medical malpractice judgment was delivered against Thomas Hospital and its outsourced transcription partner. The error originated with an SRT engine, and a series of perpetuated misinterpretations, logistical errors, and poor clinical judgments followed, resulting in the administration of an insulin dosage ten times what the patient should have received. The message to the transcription sector was resoundingly clear—Documentation errors can kill patients, and if they do, you can be held accountable in a court of law. In this general session, a panel of AHDI leaders who were consulted and/or testified in the case will explore the potentially staggering implications of this unprecedented verdict on the clinical documentation sector.
